On June 8, 2022, a district court in Chicago preliminarily approved a class action settlement in the lawsuit Marsh, et al. v. CSL Plasma Inc., Case No. 19-CV-07606.

Before any money is paid, the Court will decide whether to grant final approval of the settlement. The final approval hearing is scheduled for December 8, 2022. If the Court grants final approval of the settlement and there are no appeals, settlement payments will be distributed to class members who submitted timely and valid claim forms approximately two months later.

November 3, 2022 is the deadline to request a settlement payment.  August 22, 2022 is the deadline to request to exclude yourself from the settlement, or object to the settlement.

These are Settlement Class Members’ rights and options:

  1. Request a settlement payment. If you want to receive a settlement payment, you must complete and submit online, or postmark and mail for return, a claim form by November 3, 2022. You may submit a claim form by mail or online using your unique Claim ID and PIN. If you timely return a completed and valid claim form, and if the Court grants final approval of the settlement, you will receive a check or an electronic payment, depending on whether you file your claim form online or submit a paper claim form. You may need to complete an IRS Form W-9 to satisfy IRS tax reporting obligations related to the payment. You can complete the Form W-9 to ensure that you receive your full payment as soon as possible.
  1. Exclude yourself from the settlement and receive no money. If you do not want to be legally bound by the settlement, you must exclude yourself from the settlement by August 22, 2022. To do so, you must mail or email your written request for exclusion to the Settlement Administrator. The Settlement Administrator’s mailing address is:

Your written request for exclusion must include the case name, your full name, your address, a statement that you wish to be excluded from the settlement, and it must be personally signed by you. If you exclude yourself, you will not receive money from this settlement, but you will retain your legal rights regarding any claims that you may have against CSL Plasma Inc. and the other Released Parties.

  1. Object to the settlement. You may object to the settlement by August 22, 2022 if you have not excluded yourself from the settlement. If you want to object to the settlement, you must file the objection with the Clerk of the United States District Court for the Northern District of Illinois and e-mail or mail postmarked on or before the deadline a copy of the written statement to Class Counsel and Defendant’s Counsel at the addresses provided in the Class Notice you received. Due to the COVID-19 pandemic, the Court is accepting filing from pro se litigants via email. Instructions on how to file via email can be found at
  1. You may choose to do nothing. If you do nothing, you will receive no money or other benefits from the settlement, but you will still be bound by all orders and judgments of the Court. You will not be able to file or continue a lawsuit against the Released Parties regarding any legal claims arising out of or relating to the allegations in the Lawsuit. You will lose your right to sue CSL Plasma and the other parties being released for alleged violations of BIPA.
